Purpose. These templates exist to hold dental benefit companies accountable. They push for transparency, fair reimbursement, Medical Loss Ratio (MLR) reporting, and reasonable access to care. They are advocacy tools designed to be copied, customized, and sent to the people who can actually change things. Decades of loyalty to these plans have mostly benefited the plans. It is time the pressure flowed in the other direction.

Review before sending. Read every word before you send anything. Make sure you understand it, agree with it, and can stand behind it. Nothing deflates a strong letter faster than being asked about paragraph three and having no idea what paragraph three says. Edit for your voice and your facts.

The point we want across is simple: these decisions were not made to protect patients.

Providers. I strongly suggest you send a copy of your letter to your patients along with the patient templates included in this packet. Mail or email is fine. Do not share protected patient information.

Advocates and team members. The advocate letters can come from any team member or community supporter. It is worth the stamp and envelope to show how serious this is. Let us flood official channels with respectful, well-documented complaints, following each office’s submission rules. Polite persistence is remarkably difficult to ignore.

Transparency requests. These materials include requests for MLR reports and basic spend and denial data to verify that premium and taxpayer dollars are actually reaching patient care, not just administrative overhead and executive bonuses.

PART ONE: FILING COMPLAINTS AT THE STATE LEVEL

Regulators cannot fix what no one reports. Dental benefit companies are counting on you being too busy, too tired, or too confused to file. Prove them wrong. Here is the process, step by step.

Step 1: Understand the Role of the Department of Insurance

The Department of Insurance regulates dental benefit companies and insurers to ensure compliance with state laws and policies.

They may assist with disputes related to claims, denials, downgrades, administrative delays, restrictive plan rules, payment requirements, or other unfair practices.

While they do not represent individual dentists or patients, they act as a neutral party to enforce insurance regulations. Think of them as the referee. Referees only throw flags when someone reports the foul.

Step 2: Gather Documentation

Before contacting the Department of Insurance, gather all relevant information, such as:

Explanation of Benefits documents from your dental benefit company

Correspondence with the dental benefit company, including emails, letters, and call logs

Copies of denied claims or authorization requests

Information about your dentist’s direct contract status with the dental benefit company

A clear description of the issue, such as claim denial, downgrade, delayed processing, restrictive plan rules, or being required to pay in full at the time of service

Step 3: Contact the Dental Benefit Company First

Most Departments of Insurance require individuals to attempt resolution with their dental benefit company before filing a complaint. Yes, this means sitting through the hold music. Bring a snack.

Tips for contacting the dental benefit company:

Call customer service and request an explanation for the denial, downgrade, delay, or payment requirement.

Ask to escalate the matter to a supervisor if it is not resolved.

Request a written explanation of their decision.

Ask how your plan allows you to continue care with your dentist if your dentist is no longer directly contracted with the plan.

Step 4: File a Complaint with the Department of Insurance

If the issue remains unresolved, you may file a formal complaint with your state’s Department of Insurance.

How to file a complaint:

Locate the Department of Insurance complaint portal or form by visiting your state’s Department of Insurance website and searching “file a complaint.”

Complete the complaint form and include detailed information about the issue.

Attach supporting documentation, including Explanation of Benefits documents, denial letters, claim information, and written communication from the dental benefit company.

Clearly explain how the issue impacts your ability to continue care with your trusted dentist.

Submit the complaint online or by mail according to the instructions on the Department of Insurance website.

Step 5: Follow Up and Monitor the Process

After filing, you will usually receive a case number or reference number. Guard it like a coffee order. Follow up regularly for updates and be prepared to provide additional information if requested.

Step 6: Advocate for Broader Change

In addition to addressing individual issues, patients can advocate for broader change. Consider the following:

  • Join advocacy groups: Dental associations and patient advocacy groups may organize campaigns to address dental benefit issues.
  • Contact state representatives: Encourage lawmakers to support fair dental benefit practices that protect patients and preserve access to trusted dental providers.
  • Share your experience: Use respectful public comments, social media, community forums, or public hearings to highlight how restrictive plan rules, denials, downgrades, and payment requirements affect patients.

Additional Tips for Advocacy

Use respectful and professional language when communicating with the Department of Insurance, employer, broker, or dental benefit company. Sting with facts, not name-calling.

Emphasize the impact on patient care.

Explain how arbitrary rules, downgrades, denials, restrictive plan language, and day-of-service payment requirements can interfere with access to quality dental care.

Encourage healthcare providers and patients to document recurring issues and file complaints when appropriate. If it is not documented, it did not happen.

  • One rule before you start: never send anger without a request. Every contact should name the problem, attach the paper, and ask for a specific action. Agencies can ignore feelings. They cannot ignore a documented request with a case number attached.

DOOR 1: THE STATE INSURANCE REGULATOR

Why They Matter and the Power They Hold

  • They license the plan. Dental benefit companies cannot sell a policy in the state without this agency’s blessing, and the agency can examine, fine, and sanction them.
  • They count complaints. Regulators track complaint ratios by company. Enough complaints on the same issue can trigger a market conduct examination, which is the regulatory equivalent of an audit with teeth.
  • They force written answers. When you file, the plan is typically required to respond to the regulator in writing, on a deadline. Suddenly the company that would not return your calls becomes very articulate.

Use This Door When

  • Denials, downgrades, and bundling of care your dentist determined was necessary
  • Delays in claim processing or reimbursement checks that never seem to arrive
  • Misleading communications, including letters that pressure patients to leave a dentist who is no longer directly contracted with the plan
  • Payment rules that force members to pay in full at the time of service while the plan reimburses below what other plans consider reasonable

The End Game

  • A case number, a required written response from the plan, a complaint ratio that climbs with every filing, and eventually a market conduct examination. Individual complaints get individual fixes. Volume gets reform.

How to File

  • Go to the website below for your state and search “file a complaint.” Attach your Explanation of Benefits documents, denial letters, and correspondence. Keep your case number like it is a winning lottery ticket, because in a pattern-building sense, it is.
  • WHAT TO SAY: “I am filing a formal complaint against [Dental Benefit Company’s Name] for practices that interfere with my care: arbitrary denials, downgrades, delays, and payment rules that required me to pay in full at the time of service. My documentation is attached. I am requesting an investigation and a written response.”
  • THE FINE PRINT THAT MATTERS: state regulators oversee fully insured plans. If your employer’s plan is self-funded (the employer pays claims and the dental benefit company just administers), the state may not have jurisdiction. Ask HR one question: “Is our dental plan fully insured or self-funded?” If the answer is self-funded, your regulator is federal. That door is next.

DOOR 2: THE U.S. DEPARTMENT OF LABOR (THE DOOR NOBODY KNOWS ABOUT)

  • Here is the plot twist most patients, and honestly most dental teams, never hear: the majority of large employer benefit plans are self-funded ERISA plans. The employer pays the claims, the dental benefit company just processes the paperwork, and your state insurance regulator has little to no jurisdiction. The federal regulator for those plans is the U.S. Department of Labor, Employee Benefits Security Administration (EBSA). One agency, every state.

Why They Matter and the Power They Hold

  • They enforce federal claims rules. ERISA plans must follow federal claims procedures (29 CFR 2560.503-1): decisions on deadlines, denial notices that state the actual reason and cite the plan provision, and a full and fair appeal.
  • They can compile plan documents. You have a federal right to request your plan document and summary plan description, and administrators who stonewall can face penalties of over $100 per day.
  • Their benefits advisors intervene for free. EBSA benefits advisors contact plans directly on behalf of participants and recover real money every year doing exactly that.

  • They enforce deception laws. Every state has unfair and deceptive acts and practices statutes, and communications that mislead patients about their right to keep their dentist fit squarely inside them.
  • They build on patterns. AG offices investigate when complaints pile up on the same company and the same conduct. Multi-state AG actions have changed insurer behavior before, and every one of them started with people filling out the form.
  • Their complaints are public records. Your complaint becomes part of a searchable pattern that journalists, legislators, and other AGs can find.

Use This Door When

  • Misleading letters from the plan pressuring you to leave a dentist who is no longer directly contracted
  • Advertised benefits (“100% coverage”) that do not survive contact with reality
  • A pattern of conduct across many patients, not just one bad claim

DOOR 4: THE MEDICAID AGENCY, FAIR HEARINGS, AND THE FEDERAL OVERSEERS

Why They Matter and the Power They Hold

  • The state agency holds the contract. Medicaid dental plans exist because the state pays them. The agency can enforce, penalize, and in the ultimate case, not renew.
  • The Fair Hearing is a federal right. Under 42 CFR Part 431, Subpart E, every Medicaid member can demand a hearing on a denial or reduction. The plan must defend its decision on the record, in front of a judge, at real cost to itself. Plans settle plenty of these rather than defend the indefensible.
  • CMS watches the states. The Centers for Medicare and Medicaid Services oversees managed care contracts and medical loss ratio reporting. States answer to CMS, plans answer to states, and pressure rolls downhill.
  • The OIG hunts waste. The HHS Office of Inspector General takes tips on Medicaid fraud, waste, and abuse, and taxpayer dollars flowing to overhead instead of care is exactly their beat.

  • Access problems: no available contracted dentist within reasonable distance or time

Why They Matter and the Power They Hold

  • They appoint the referees. In most states the insurance commissioner serves at the pleasure of the Governor. A Governor’s office inquiry moves regulators like nothing else.
  • They write the insurance code. Assignment of benefits laws, non-covered services laws, and network transparency laws exist in multiple states because constituents made noise. The rule forcing members to pay in full at the time of service is exactly the kind of thing a statute can end.
  • Constituent services actually work. Every Governor and legislator has staff whose entire job is untangling constituent problems with state agencies. Use them.

  • They aggregate the pattern. Associations track third-party payer complaints across thousands of practices. Your one bad experience becomes industry-wide data they take to legislatures, regulators, and courts.
  • They lobby with receipts. State dental associations drove the assignment of benefits and non-covered services laws that already exist. They cannot fight with data they never receive.
  • Organized dentistry litigates. Dentists have pursued organized legal action against dental benefit companies, including class litigation over network practices, and the ADA reports on and tracks these fights. Documentation from practices like yours is the fuel.

The result is reduced access in violation of Medicaid’s equal-access standard (42 C.F.R. § 447.204). I request that the hearing officer order coverage and allow treatment without a separate pre-treatment visit, and that the agency cease using administrative hurdles that delay care.”
